Terms of Service
1. Who we are, and some definitions
These Terms are between you and Borun Studios Ltd, a company registered in England and Wales (company number 16757096, registered office Flat 28 Ravensbourne Court, 1 Amias Drive, Edgware HA8 8EY, United Kingdom) (“Takin”, “we”, “us” or “our”), and they govern your use of the Takin app and the gotakin.com website (together, “the Service”).
In these Terms: “you” means the person using the Service; “Content” means anything you import or enter, such as bank statements, screenshots, photos, transactions and mileage; and “Pro” means the paid Takin Pro plan.

2. Agreeing to these Terms
By downloading, or using, the Service you agree to these Terms and to our Privacy Policy, which forms part of them. If you do not agree, please do not use the Service. You must be at least 18 to use Takin.
3. What Takin is, and is not
Takin is a self-service tool that helps self-employed Universal Credit claimants organise their income, expenses and mileage and prepare their monthly UC report.
Takin is not financial, tax, accounting or legal advice. It does not submit anything on your behalf. You check every figure with the DWP, HMRC, or a qualified accountant before you rely on it or report it.
4. What you import is your responsibility
Takin reads figures from the Content you choose to import. It cannot and does not verify that your Content is genuine, complete or unaltered. It simply reads what it is given.
You are responsible for the authenticity and accuracy of everything you import. If you import Content that has been edited, altered, manipulated, falsified, or is otherwise not a true and unaltered record, that is your responsibility, not ours. Submitting inaccurate or falsified information to the DWP or HMRC may be a criminal offence for which you, not Takin, are responsible.
5. Our system can make errors. You check and submit.
Takin uses automated processing, including AI-based reading, to read your Content and suggest amounts and categories. This processing can be wrong. It may misread a number, miss a transaction, duplicate or invent a row, pick the wrong category, or miscalculate.
Everything Takin suggests is a starting point you must verify. It is your responsibility to review, correct and confirm every figure before you submit anything to the DWP, HMRC or anyone else. You alone decide what to report, and you are responsible for what you submit.
6. Your account
You can use Takin without an account, with your Content kept on your device. Creating an account adds backup, sync across devices, emailing statements in, and Pro.
You are responsible for keeping access to your account secure, and for the accuracy of the details you give us. You can delete your account, and its synced data, at any time inside the app.
7. Acceptable use
Use the Service only for your own lawful record-keeping. Do not use it to store other people’s data without a proper reason, to break the law, or to interfere with or attempt to gain unauthorised access to the Service or other users’ data. Your imported records may incidentally contain other people’s details (for example a payer named on a statement); you remain responsible for your own records.
8. Takin Pro and payments
Takin offers a free plan and a paid plan, Pro. Where you subscribe through the App Store, Apple handles the payment and billing under Apple’s terms, and you manage or cancel the subscription in your App Store account. Subscriptions renew until cancelled.
If your Pro subscription ends, we do not delete the Content you recorded. Your view and export are limited to the free plan, and everything returns if you subscribe again.
9. Your data and privacy
How we handle your data is set out in our Privacy Policy, which forms part of these Terms. Please read it.
10. Our content, and your licence to use it
The Service, and everything in it except your Content (the software, design, text and brand), belongs to us or our licensors and is protected by law. We give you a personal, non-exclusive, non-transferable licence to use the Service for your own record-keeping while you comply with these Terms.
Your Content stays yours. You give us only the permission we need to store, process and display it to provide the Service to you.
11. The App Store
If you download Takin from the Apple App Store, Apple’s standard Licensed Application End User License Agreement also applies, and Apple is a third-party beneficiary of these Terms and may enforce them. Apple is not responsible for the Service or for support.
12. The Service is provided as is
We work hard to make Takin useful and reliable, but, to the extent the law allows, we provide it “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, or that any figure it produces is accurate or fit for a particular purpose. This does not affect your statutory rights (see section 13).
13. Our responsibility to you
Nothing in these Terms limits or excludes our liability where the law does not allow it. In particular, we do not exclude our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. Your rights as a consumer under the Consumer Rights Act 2015, including that a paid service is provided with reasonable care and skill, are not affected by these Terms.
Subject to that: Takin is a tool you use to prepare your own figures, and you are responsible for checking and submitting them (sections 4 and 5). We are not responsible for any decision, delay, penalty, overpayment, underpayment, sanction, loss or damage that follows from a figure you reviewed and chose to report, or from Content you imported that was not a true record.
We are not liable for loss that was not a foreseeable result of a breach by us, or for loss of profit or other indirect or consequential loss. If we are found liable to you despite the above, our total liability to you is limited to the greater of the amount you paid us for Pro in the 12 months before the claim, or £50.
14. Changes, suspension and ending
We may update the Service and these Terms from time to time. When a change to these Terms is important, we will tell you in the app; continuing to use the Service after that means you accept the change. You may stop using Takin and delete your account at any time. We may suspend or end your access if these Terms are seriously or repeatedly broken.
15. General
If any part of these Terms is found to be invalid, the rest continue to apply. If we do not enforce a right, that is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a company that takes over the Service, without reducing your rights. These Terms and the Privacy Policy are the whole agreement between us about the Service. We are not responsible for a failure caused by something beyond our reasonable control.
16. Governing law
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, unless the law of the part of the UK where you live gives you a right to bring proceedings there.
